Housing discrimination — pathway to the HRTO

Ontario’s Human Rights Code prohibits discrimination in occupancy of accommodation because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, gender expression, age, marital status, family status, disability, and receipt of public assistance. Refusing a tenant because they are on ODSP, because they have children, or because of a disability is unlawful. You generally have one year from the last incident to apply to the Human Rights Tribunal of Ontario. The Human Rights Legal Support Centre can help. The Code prevails over the RTA and the Housing Services Act unless those Acts expressly say otherwise.
