The right is written.
The cheque is not.
Canada ratified adequate housing. Parliament named it a right in 2019. Ministers stood up, again and again, and promised to lift people with disabilities out of poverty. The cheque that arrived is $204.20. Ontario Works still pays $733. ODSP still pays $1,436. A Toronto 1-bed is $1,985. Stack every federal top-up and a single adult on ODSP is still under Toronto’s deep-poverty line. That is not a shortfall in compassion. It is legislated destitution and legislated poverty — a shameful public choice after a decade of promises. Elected officials have to raise the rates, pay the rent gap, build RGI, and house people first. If they stay blind, minimize the gap, and keep spending on the hospital and the motel instead of the key, the statutes they already passed describe the next step: name the breach, and consider the forums that can hear it.

Unsheltered
Outside, in a vehicle, in an encampment. No shelter line on the OW or ODSP cheque. Ottawa’s 2025 PiT counted 561 people outside.
Emergency sheltered
Dorms, respites, motels paid as overflow. Toronto: 7,295 people on 17 September 2026. Family rooms 98.1%. Women’s emergency 97.9%. Respites 100%.
Provisionally accommodated
Couch, institution on the eve of discharge, a motel billed as family shelter for eleven months. Hidden from some counts. Still not a tenancy.
At risk
Paying more than 30% of income, or the entire cheque, for rent. Core housing need. One missed month from the list above. This is where most people on OW and ODSP already live.
Housing First is the method. Rights name the duty.
A person should never have to earn a home through sobriety, treatment compliance, or good behaviour. Housing comes first. Support is offered after — never as a condition of the key.
Leilani Farha, former UN Special Rapporteur on the Right to Adequate Housing: housing is not gold. When governments, developers and private-equity funds treat a home as the safest place to park capital, they have left the human-rights frame. People who are unhoused already know the right. They say, surely I am not meant to live this life. Surely I am entitled to a life of dignity. Dignity is the core of the right. The statute is already written. The cheque is not.
The Human Rights Code has primacy in Ontario housing. Receipt of public assistance is a protected ground. CESCR General Comment No. 4 forbids treating a roof as the whole right. The National Housing Strategy Act tells the federal government to progressively realize that right. None of those texts are awaiting invention. They are awaiting a budget that can rent a room and a government table that will sit in the same month.
They said “lift out of poverty.” They wrote $204.
Watch the record. The Prime Minister, parliamentary secretaries, and C-22 itself were sold as the instrument that would lift persons with disabilities out of poverty. The Canada Disability Benefit maximum for July 2026–June 2027 is $204.20 a month — $6.70 a day — and only if the person already holds a Disability Tax Credit.
ODSP $1,436 + CDB $204 + the GST-replacement credit + Trillium ≈ $1,767. Toronto’s official poverty line for a single adult is $2,444. Deep poverty is $1,833. The stacked “lift” does not clear deep poverty. That is not a rounding error. It is a broken promise, published as a benefit.

Waterloo Region put a fourth number on an invoice. External counsel to clear the encampment at Victoria and Weber: $1,695,006 over fourteen months — 1,522 billed hours, twenty-one lawyers in the room. Justice Gibson held the by-law unconstitutional under Charter ss. 7 and 15 (2026 ONSC 2971). The Region and the Province appealed. That $1.7 million is the floor. It does not include the 2023 Charter file, staff time, or the appeal. It would have bought about 424 months of supportive housing at $4,000. Cities that declare a housing crisis and then spend the crisis budget on lawyers to move tents are not managing scarcity. They are choosing the expensive cruelty.
