Social assistance rates

Canada Disability Benefit and tax credits

• Canada.ca, Canada Disability Benefit amount — maximum $204.20/month for July 2026–June 2027. Requires an approved Disability Tax Credit. Ontario treats CDB as exempt income for ODSP and OW. C-22 was introduced and debated as the instrument that would lift persons with disabilities out of poverty.

• National Housing Strategy Act, S.C. 2019, c. 29, ss. 13–16.1 — Federal Housing Advocate receives systemic submissions, may review, and may request a National Housing Council review panel.
• Office of the Federal Housing Advocate / CHRC — submission tool for systemic housing issues. The Advocate does not award individual damages.
• ARCH Disability Law Centre — Canada ratified the CRPD in 2010 and the Optional Protocol in 2018. Individual communications require exhaustion of domestic remedies.
• Canada has not ratified the Optional Protocol to the ICESCR. There is no individual CESCR complaint mechanism for people in Canada.
• Tanudjaja v. Canada (Attorney General), 2014 ONCA 852 — a free-standing Charter ss. 7 and 15 claim against the social conditions of homelessness, without targeting a particular statute or decision, was struck as not justiciable. The Supreme Court of Canada refused leave.
• Victoria (City) v. Adams, 2008 BCSC 1363 / 2009 BCCA 563; Abbotsford (City) v. Shantz, 2015 BCSC 1909 — limits on by-laws that prevent people from sheltering themselves when no adequate indoor option exists.
• The Regional Municipality of Waterloo v. Named Respondents and Persons Unknown, 2026 ONSC 2971 (Gibson J., 21 May 2026) — site-specific and amended by-laws at 100 Victoria Street North of no force and effect under Charter ss. 7 and 15; homelessness recognized as an analogous ground; injunction against enforcement. Justice Valente’s 2023 decision on the same site had already found a Charter problem with clearing it.
• CTV News Kitchener, 18 September 2026 — FOI obtained by Simon Guthrie: $1,695,006.13 to Paliare Roland Rosenberg Rothstein LLP over 14 months (1,522.4 hours) described as “encampment issues”; $27,113.10 paid to Waterloo Region Community Legal Services on the injunction motion. Excludes 2023 litigation and staff time. The Region and the Province appealed. Premier Ford publicly floated the notwithstanding clause.
• Waterloo Region Community Legal Services, as broadcast: the fees were spent because of policy choices while people were left without adequate solutions and forced to sleep outdoors; public funds would be better spent on solutions that actually house people.
• Pennsylvania Shelter First Act — SB 1089 (Saval) and HB 2028 (Smith-Wade-El), 2025–26 session. Municipalities must show adequate indoor space (free, ongoing, disability-accessible, partners, pets, property) before enforcing anti-camping or anti-sleeping rules. Introduced after City of Grants Pass v. Johnson (U.S. 2024).
